Planning for Institutional Long-Term Care
Under NC's Assistance Programs After Changes of 2007
J. Gregory Wallace, Esq. will discuss the growing problem of long-term care provision in light of the recent changes in both Federal and State-level legislation. The changing regulation in North Carolina of the program of Medicaid for the Aged, Blind and Disabled will include addressing issues involving care level determination, applicant income considerations, applicant resource availability and the effect of asset transfers. Further discussion will be offered in light of the post-DEFRA '05 environment, to include lookback provisions, transfers for less than fair market value, the treatment of annuities and exclusions relevant to primary residence.

J. Gregory Wallace has been practicing law in North Carolina since 1973. A graduate of the UNC law school at Chapel Hill, he has taught at the U.S. Naval Academy, served as an Assistant Attorney General for North Carolina, was Clerk of the Supreme Court of North Carolina for ten years, and is a partner in the Raleigh law firm of Monroe, Wyne & Wallace.
His practice focuses on Elder Law: coordinating planning for long-term care and financing, physical or mental incapacity, advance directives, guardianships, and administration and management of trusts and estates.
Greg is a member of the National Academy of Elder Law Attorneys and is Co-President of the North Carolina Chapter of NAELA. He is Past Chair of the Elder Law Section of the North Carolina Bar Association, is a member of the Boards of Directors of Resources for Seniors, Inc., and the Eastern NC Chapter of the Alzheimer’s Association, and is retired from the United States Naval Reserve as a Captain in the Judge Advocate General’s Corps.
